Schools reopen in Campania: the TAR suspends the order of De Luca

Gear shift for the schools in Naples that indeed they will reopen immediately because it was accepted the appeal presented against the order of the President Vincenzo De Luca who had ordered the closure of nursery, primary and secondary schools.

Il Tar of Campania it accepted the appeals of the parents and of the Government and also of the “no Dad” associations.

When schools reopen in Campania

According to the order of De Luca, the schools should have reopened on January 30, but the decision of the TAR provides for the immediate suspension of the provision and therefore they will reopen already tomorrow 11 January. This applies to the mother, elementary and medium.

High schools normally reopened on January 10th following national provisions, but from tomorrow the nursery, primary and secondary schools will also be able to reopen.

The anti-Covid regulations envisaged by the Government

The TAR specified that the government decree provides for very specific anti-Covid rules that allow the return to school because they include:

  • thevaccine obligation to school staff
  • the extension ofvaccine obligation for over 50s since February;
  • the obligation to use the masks FFP2;
  • theGreen Pass obligation;
  • the management of infections in the education, training and school system;
  • urgent measures for tracing the infections.

The regional ordinance against the decree

The Tar points out that only in the red zone can the Regions decide to use Dad and to close schools, therefore De Luca's provision is in contrast with the government decree.
